CHAPTER ONE
WORK PERMIT AND RELATED MATTERS
ARTICLE (23)
WORK PERMIT

a.The foreign worker is prohibited from engaging in any occupation in the Kingdom without issuing a work permit for him according to the provisions of this Law.

b. The employer is prohibited from using a foreign worker without issuing a work permit for him according to the provisions of this Law. Also, the employer is prohibited from using this worker in violation of the provisions of this Law or the conditions of the permit. The employer shall ensure the nationality of the worker before hiring him.

c. The employer is prohibited from submitting data, information or documents contrary to reality, in order to obtain a work permit, without having an actual need of it. He is also prohibited from keeping the work permit when no longer needed *

d. It is prohibited to collect any amounts or obtain any benefit or benefit from a worker in consideration of issuing a work permit to him or for hiring this worker or continuing his employment with him.

 

The provision of Article (23) has been amended as per Article One of Law No. (40) of 2014, Amending some of the Law provisions No. (19) of 2006, with regard to the Regulation of Labour Market, by adding the provisions of paragraph (c) re-arranging the paragraphs of this Article.
